Estate with Heirs in Three Countries

Challenge

A Chiang Mai landowner died leaving adult children in Thailand, Germany, and Australia. The estate included four Chanote title plots and a modest family business. No will existed. The heirs had not been in regular contact and had different views about what should happen to the land.

What We Did

We carried out the full heir identification and verification process, coordinating certified translations of German and Australian documents for submission to the Thai court. We assisted in the appointment of a court administrator and provided each heir with a clear written explanation of their entitlement and the process for receiving it.

Outcome

The estate was administered and the assets distributed within eleven months of the first instruction. All four heirs confirmed in writing that the process had been handled fairly. The business was sold at a value agreed between the heirs, with the proceeds distributed according to the verified entitlements.

Disputed Will — Capacity Question

Challenge

A client came to us after her father signed a new will in the final weeks of a serious illness, leaving the bulk of his estate to a much younger companion rather than his three adult children. The children believed their father had lacked capacity at the time and that the companion had played an undue role in the document's preparation.

What We Did

We undertook a careful preliminary review of the medical circumstances, the timing of the will, and the involvement of others in its preparation. We advised honestly that the case had meaningful grounds but carried genuine uncertainty. The client chose to proceed. We gathered medical and witness evidence over three months and represented the family in civil court proceedings.

Outcome

The court found in favour of the children on grounds of diminished testamentary capacity. The estate was distributed under the earlier valid will. The matter took approximately eight months from instruction to judgment.

Long-Term Family Estate Planning

Challenge

A family with three generations of land holdings in the Mae Rim and Hang Dong districts, an import business, and grandchildren still in education engaged us to bring order to their succession arrangements. The patriarch was in his seventies and wanted to ensure that his intentions for each of his children and grandchildren were clearly documented and could be carried out without family difficulty.

What We Did

Over six months we mapped the full extent of the family's assets and prepared a comprehensive set of estate documents, including updated wills for both spouses, land transfer arrangements for specific plots, and documented provisions for grandchildren to receive their shares at appropriate ages. We have since met annually to review and update as circumstances have changed.

Outcome

Four years into the relationship, the documentation has been updated twice following changes in the family — one child's marriage and the sale of one of the land plots. The family reports that the patriarch has significant peace of mind about the arrangements, and the children are aware of and comfortable with the plans for their respective inheritances.
